Terms & Conditions

Sjøbris Adventure AS, Gate 6 79, 6700 Måløy, org.no. 923 225 323, provides guided activities, experiences, rentals and related products and services.

1. General

These Terms & Conditions apply to all bookings, purchases, rentals, activities, experiences, and services provided by Sjøbris Adventure AS, whether booked through our website, by email, telephone, or other agreed booking channels. By confirming a booking or purchase, you agree to these Terms & Conditions.

2. Definition of Parties

Sjøbris Adventure AS is the provider of activities, experiences, rentals and related products and services, and is hereinafter referred to as we, us, Sjøbris Adventure, provider, seller, or lessor.

The Customer is the person or company specified in the booking, order or rental agreement and is hereinafter referred to as customer, participant, guest, you, your, or yours.

The term "Services" refers to guided activities, experiences, tours, transport arrangements and other services provided by Sjøbris Adventure.

The term "Rental Objects" refers to equipment and other items rented from Sjøbris Adventure.

The term "Products" refers to goods purchased from Sjøbris Adventure.

3. Payment and Prices

Payment terms are specified during the booking or purchase process. The customer may be required to pay in full at the time of booking, unless otherwise agreed.

Sjøbris Adventure may also issue an invoice with a 14-day payment term.

All prices include VAT unless otherwise stated. The total price will be clearly presented before confirmation of the booking, rental, or purchase and includes all applicable costs and fees.

If significant pricing errors occur due to technical issues, incorrect information, or other circumstances beyond Sjøbris Adventure’s control, Sjøbris Adventure reserves the right to correct, cancel, or reject the booking or purchase. In such cases, the customer will be informed within a reasonable time after the error has been identified.

4. Equipment, Facilities and Customer Responsibilities

Sjøbris Adventure provides equipment, facilities, and related resources that may be included as part of an activity, experience, or rental service.

All equipment and facilities are regularly inspected, maintained, and prepared according to our safety procedures. Customers are responsible for using all equipment and facilities correctly, safely, and in accordance with instructions provided by Sjøbris Adventure.

Before participating in activities or using equipment or facilities, customers must familiarize themselves with relevant safety information and follow all applicable rules and instructions.

Sjøbris Adventure reserves the right to refuse participation or access to equipment and facilities if safety requirements are not met.

5. Liability During Activities and Experiences

Sjøbris Adventure will make reasonable efforts to provide activities and experiences as described and in accordance with applicable safety procedures.

Participation in activities and use of equipment or facilities provided by Sjøbris Adventure involve a certain level of risk. Customers are responsible for acting with due care, following safety instructions, and informing Sjøbris Adventure of any circumstances that may affect safe participation.

Customers are encouraged to have adequate travel and activity-related insurance coverage.

Sjøbris Adventure is not responsible for accidents, injuries, illness, loss, theft, or damage to personal belongings arising from circumstances outside Sjøbris Adventure’s control, or where the customer has failed to follow instructions or safety requirements.

Sjøbris Adventure is not responsible for delays, additional costs, missed connections, or other consequences resulting from circumstances beyond our reasonable control.

Nothing in these Terms & Conditions excludes liability where such liability cannot legally be excluded.

6. Damage, Loss, or Misuse of Equipment

Any damage, loss, technical issues, or accidents involving equipment provided by Sjøbris Adventure must be reported immediately.

The customer may be held responsible for repair or replacement costs if equipment is damaged, lost, or misused due to negligence, intentional actions, failure to follow instructions, or use beyond its intended purpose.

This applies to equipment rented, borrowed, or provided as part of an activity or experience.

Normal wear and tear resulting from proper use is not considered damage.

7. Customer Information and Rights

The customer placing the booking or purchase must be at least 18 years old and is responsible for providing accurate and complete contact information when booking activities, experiences, rentals, or purchasing products from Sjøbris Adventure.

Participants under the age of 18 must be accompanied by an adult unless otherwise agreed. In cases where a participant under 18 years old takes part without an accompanying adult, approval from a parent or legal guardian may be required.

Sjøbris Adventure may use the provided contact information to send booking confirmations, practical information, safety information, changes, and other relevant communication related to the booking or agreement.

Such communication is considered received when sent to the contact details provided by the customer.

Sjøbris Adventure reserves the right to refuse, cancel, or terminate bookings, rentals, or access to services if these terms and conditions are violated or if safety, operational, or other legitimate considerations require it.

8. Cancellation and Amendment of Order

To cancel or change a booking, Sjøbris Adventure must be contacted directly. Changes are only valid once confirmed in writing. All deadlines are based on the scheduled start time.

Standard Experiences

Standard experiences are scheduled activities with fixed content and departure times, open to individual bookings.

  • Free cancellation or changes up to 24 hours before start

  • Less than 24 hours: non-refundable

Tailored or Curated Experiences

Tailored or curated experiences are customized or private arrangements designed for specific guests or groups.

  • Free cancellation or changes up to 7 days before start

  • 3–7 days: 50% refund

  • Less than 72 hours: non-refundable

Documented Circumstances
In cases such as illness or major travel disruptions (e.g. cruise cancellations), we may offer flexibility upon documentation.

Our Responsibility
If we cancel due to technical or operational reasons, you will receive a full refund.

Force Majeure
In the event of force majeure, Sjøbris Adventure will assess each situation individually. Refunds, alternative arrangements, or credits may be offered where appropriate.

9. Right of Withdrawal on Purchase

The right of withdrawal applies only to eligible purchases of physical products and does not normally apply to activities, experiences, services, or rentals where exemptions under applicable consumer legislation apply. The right of withdrawal requires that you notify us no later than 14 days after receiving the delivery.

To exercise the right of withdrawal, the product must be returned to us in approximately the same quantity and condition as you received it.

The product is returned to us in its original packaging and in a reasonable time, along with the withdrawal form. If you choose to return it by mail or other methods, it is your responsibility until the item reaches us. You must provide your own suitable packaging and contact us before shipping.

10. Privacy

Sjøbris Adventure processes personal information necessary to manage bookings, purchases, rentals, communication, customer service, accounting obligations, and to fulfil agreements with customers.

The information processed may include name, contact details, booking information, payment information, and other information provided by the customer in connection with participation in activities or use of our services.

Booking information is managed through our booking system, Bilberry. Communication related to bookings may take place by email, telephone, or other contact details provided by the customer.

Payments are processed securely through our payment providers, including Nets and Vipps. Sjøbris Adventure does not store complete payment card details or other sensitive payment credentials.

Personal information is retained only for as long as necessary to fulfil our contractual obligations, comply with applicable legal requirements, and protect our legitimate interests.

Customers have the right to request access to, correction of, or deletion of their personal information where applicable under relevant data protection legislation. Requests can be made by contacting Sjøbris Adventure.

Sjøbris Adventure uses cookies and similar technologies on our website to provide essential functionality, improve user experience, analyze website usage, and support the operation of our online services.

11. Changes

Sjøbris Adventure reserves the right to change or replace these terms at any time. The applicable terms are always available at www.sjobrisadventure.no. If Sjøbris Adventure considers the changes in the terms to be significant in relation to the lcustomers's rights or obligations, the changes will be made available on www.sjobrisadventure.no 30 days before they take effect.
